1. Who is responsible

This website, emergingbites.com, is operated by Emerging Bites Holding GmbH, Wiedner Gürtel 13, 1100 Vienna, Austria (c/o TPA Steuerberatung), registered in the Austrian commercial register under FN 682438k. We are the controller within the meaning of the EU General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG). You can reach our team at info@emergingbites.com.

2. What we collect and why

Visiting the website. When you visit emergingbites.com, our hosting provider automatically processes technical data such as your IP address, browser type, device, the pages you visit and the time of access. This is needed to deliver the website securely and to prevent misuse. The legal basis is Article 6(1)(f) GDPR.

Area development application form. If you apply to become an area development partner, “Emerging Bites” processes the information you enter in the form: your name, email address, phone number, company and role, the country and territory you are interested in, your current portfolio and brands, your development ambition, how you intend to fund the plan, your preferred timing, how you heard about us, and the free text you provide. We use this to review your application, contact you about it and, if both sides wish to go ahead, prepare discussions about a development agreement. The legal basis is your consent (Article 6(1)(a) GDPR) and steps taken at your request before entering into a contract (Article 6(1)(b) GDPR). You can withdraw your consent at any time by emailing info@emergingbites.com.

Contacting us by email. If you write to us, your message and contact details are processed to handle your enquiry (Article 6(1)(b) and (f) GDPR).

3. Who receives your data

Your data is handled by our franchise development team. We use these service providers as processors under data processing agreements: Squarespace Ireland Ltd. and Squarespace, Inc. (website hosting and form submissions) and Google Ireland Ltd. (Google Workspace for email and document storage). Transfers outside the EU are covered by the EU standard contractual clauses and the EU U.S. Data Privacy Framework. “Emerging Bites” does not sell your data. Application data may be shared with the franchisor Subway International B.V. only where this is necessary to progress a development agreement, and we will tell you before this happens.

4. How long we keep your data

Application data is kept while your application is under review and for up to 24 months afterwards, so we can come back to you about future opportunities, unless you ask us to delete it earlier. If a development agreement is concluded, the data is kept for the duration of the relationship and the statutory retention periods that follow (in Austria generally seven years for commercial records). Technical log data is deleted within a few weeks.

5. Cookies

emergingbites.com only uses cookies that are technically necessary for the website to work. We do not use advertising or tracking cookies.

6. Your rights

You have the right to access your data, have it corrected or deleted, restrict its processing, receive it in a portable format, object to processing based on legitimate interests, and withdraw any consent you have given. Email info@emergingbites.com to use these rights. You can also complain to the Austrian Datenschutzbehörde, Barichgasse 40 to 42, 1030 Vienna, dsb.gv.at.

7. Security

We protect your data with appropriate technical and organisational measures, including encrypted transmission (TLS) and access limited to the people who need it for their work.

8. Changes to this policy

We may update this policy from time to time. The current version is always available at emergingbites.com/privacy.
